Kansas Legislative Update 03-26-2010

Legislative Report for the Leawood Chamber of Commerce
For week ending March 26, 2010
From Bob Vancrum, Kansas Government Affairs Consultant

The Legislature has now completed the eleventh week of its Legislative Session. Most members went home, but on Thursday and Friday many worked on conference committees.  They plan to work only 2 or 3 days next week and adjourn until the veto session.  In fact, they will have only logged about 70 paid days out of their usual 90 day regular session.  They have cut their pay by 5% and their staff will be paid for about 75-78 days.

Economic Development
One of the week’s highlights was the passage in the full Senate (40-0) of Senate Substitute for HB2538, a revised PEAK bill now with almost no net fiscal note.  It allows possible tax incentives to any business that creates jobs in Kansas no matter how small.  Apparently it will go to conference committee but should be voted upon in the House next week.  Since the Revenue Secretary is now on board, everyone assumes the Governor will sign the bill.  The bill takes away business and job income tax credits in the six urban counties to balance the fiscal note.  It also contains a total annual cap of no more than $4.8 million worth of payroll tax incentives which can be approved by the Department of Commerce in any one year.  It cannot be combined with either HPIP or IMPACT, but both pro ... Payroll News: Job creation bill eliminates Social Security taxes for new hires

On March 18, 2010, President Obama signed the Hiring Incentive to Restore Employment Act (HIRE Act), also referred to as the “jobs bill.”

This bill provides significant tax credits to businesses that hire unemployed workers. One of the major provisions of the HIRE Act includes a limited Social Security tax “holiday.” An exemption will be granted for an employer’s 6.2% Social Security (FICA) payroll contribution (up to the FICA wage cap of $106,800). For example, if an employer hired a qualified worker and paid the employee $53,400 by the end of 2010; the employer would save a maximum of $3,310. Additionally, a separate business tax credit is available if the new employee remains employed for 52 consecutive weeks.

A qualified employee is an individual who:

  1. Begins employment after February 3, 2010, and before January 1, 2011.
  2. Certifies in a signed affidavit, under penalties of perjury, that the individual has not been employed for more than 40 hours during the 60-day period ending on the day the individual begins work for the qualified employer.
  3. Is not employed by the qualified employer to replace another employee unless the other employee left employment voluntarily or was terminated for cause.
  4. Is not related to the qualified employer or to anyone owning 50% or more of the stock or other capital of the employer.

The bill provides Social Security tax relief on wages ... (go to www.leawoodchamber.org for more information)

Heartland Spine & Specialty Hospital Undergoes Name Change

Overland Park, KS (March 29, 2010) —Heartland Spine & Specialty Hospital, founded in 2003, announced today its name has changed to more accurately reflect the variety of services offered at the physician-owned hospital.

The hospital’s founders voted to change the name of the hospital to Heartland Surgical Specialty Hospital. “Heartland is dedicated to providing the best possible care to patients,” said Federico Gonzalez, M.D., Chairman of the Board of Directors. “We have worked to continually improve the services we provide and the quality of care we deliver to our patients and their families. Our new name more accurately reflects the expanded services we provide our patients and the communities we serve.”

Founded in 2003, the 80 members of Heartland’s medical staff provide a broad range of professional services, including orthopedic and spine surgery, plastic surgery, neurosurgery, hand surgery, general surgery, weight loss surgery, primary care medicine, and ear, nose and throat surgery, as well as many others.

Heartland’s Chief Executive Officer, Don Burman, echoed Dr. Gonzalez’ statement and noted that Heartland was recently recognized by Press Ganey & Associates for the hospital’s ongoing effort to improve customer service and customer satisfaction. “Our recent Press Ganey Summit Award, the only recipient in Kansas, underscores our continued commitment ...
